On August 16, 2013, Partner Kevin J. Todd and Associate Meghan T. Davis were successful in the Appellate Court, First District, in obtaining a unanimous reversal of a ruling of the probate court that had dismissed the will contest complaint of their client, Thomas Golly, a farmer from Minnesota. The Appellate Court’s 19-page opinion drew on well-established Illinois law, as well as a decision of the Illinois Supreme Court issued after the trial court’s ruling, making clear that Mr. Golly’s complaint easily met these standards for pleading causes of action for undue influence and tortious interference with testamentary expectancy. The Appellate Court ruled the case should be reinstated and Mr. Golly and his legal team at Hoogendoorn & Talbot should be allowed to proceed in the probate court with this case.
