Deborah Cole represented plaintiff First Position, Inc., an entrepreneurial investment and development company, in litigation brought against 3650 LLC, et al, over an industrial land parcel worth $700,000. The case was heard in the circuit Court of Cook County, Illinois. After a full briefing and oral argument on a contested Motion for Judgment of Consent Foreclosure, the court entered judgment in favor of First Position, Inc., extinguished all junior liens, and vested the title to the commercial real estate parcel in our client. The case was a rare application of the Illinois statuary Consent Foreclosure procedure to extinguish the interests of objecting junior mortgagees. Our client acquired a valuable piece of industrial property that provided key access to rail lines and ground transportation corridors.
